📜 Terms of Service

1. Acceptance of Terms

By accessing or using the AmbrionServ platform (website at ambrion.in or our mobile application), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use our platform.

These Terms constitute a legally binding agreement between you and AmbrionServ. We reserve the right to update these Terms at any time, and continued use of the platform constitutes acceptance of the revised Terms.

2. About AmbrionServ

AmbrionServ is an online service marketplace platform that connects customers ("Customers") with independent skilled service providers ("Providers") such as makeup artists, beauty professionals, and other home-service experts across India.

3. Eligibility & Account Registration

• You must be at least 18 years of age to create an account and use AmbrionServ.
• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You may not create multiple accounts or share your account with others.
• AmbrionServ reserves the right to suspend or terminate accounts that violate these terms.

4. Platform Roles

4.1 Customer

As a Customer, you can browse service provider profiles, book services, communicate with providers via in-app chat, and leave reviews after service completion.

4.2 Service Provider

As a Provider, you can create a professional profile, list your services and pricing, accept or decline booking requests, and communicate with customers. Providers must:

• Maintain accurate and up-to-date profile information.
• Deliver services as agreed with the customer at the time of booking.
• Behave professionally and respectfully at all times.
• Hold any necessary licenses or certifications required for their services.

4.3 Dual Role

Users may hold both Customer and Provider roles on the same account. Profile data (reviews, ratings, portfolio) is role-specific and does not cross over between roles.

5. Payments & Subscription Plans

Providers pay a subscription fee to AmbrionServ to access premium platform features. Payments are processed via Razorpay. Current plans are:

AmbrionServ does not take any commission on individual jobs or service transactions. Providers keep 100% of the money they earn directly from customers.

5.3 Subscription Billing

• Subscriptions are billed monthly from the date of activation.
• Plan upgrades take effect immediately; plan downgrades are not permitted mid-cycle.
• If a plan expires, the provider's profile reverts to the Basic tier.

6. Bookings

• A booking is a request from a customer to a provider for a specific service.
• Providers may accept or decline any booking request at their discretion.
• Accepted bookings are a commitment between the customer and provider. Cancellations should be communicated in advance through in-app chat.
• AmbrionServ is not responsible for any loss, inconvenience, or damages arising from cancelled or incomplete bookings.

7. User Content & Conduct

You are solely responsible for all content (photos, videos, messages, reviews) you post on the platform. You agree NOT to:

• Post false, misleading, or defamatory content.
• Upload obscene, offensive, or illegal content.
• Impersonate another person or entity.
• Use the platform for spam, fraud, or scam activities.
• Attempt to hack, disrupt, or damage the platform or its infrastructure.
• Use automated bots or scrapers to collect data from the platform.
• Solicit users to transact outside the platform in a manner that violates these terms.

8. Reviews & Ratings

• Customers may leave a review after a booking is marked as completed.
• Reviews must be honest, fair, and based on actual service experience.
• Fake or manipulated reviews are strictly prohibited and will result in account termination.
• Providers may not offer incentives in exchange for positive reviews.
• AmbrionServ reserves the right to remove any review that violates our guidelines.

9. Intellectual Property

All content, branding, design, logos, and code of the AmbrionServ platform are the exclusive intellectual property of AmbrionServ. You may not reproduce, distribute, or create derivative works without our explicit written consent.

By uploading content (photos, videos) to your profile, you grant AmbrionServ a non-exclusive, royalty-free license to display this content on the platform for promotional and operational purposes.

10. Limitation of Liability

To the maximum extent permitted by applicable law, AmbrionServ shall not be liable for:

• The quality, safety, legality, or reliability of services provided by Providers.
• Direct or indirect payments made between customers and providers.
• Any loss, injury, or damage resulting from a service transaction.
• Platform downtime, technical errors, or data loss beyond our reasonable control.
• Actions or omissions of any third-party service (Firebase, Razorpay, Cloudinary, etc.).

Our total liability to you in any matter shall not exceed the amount you paid to AmbrionServ (subscription fees) in the 3 months prior to the claim.

11. Governing Law

These Terms are governed by the laws of India. Any disputes arising from the use of AmbrionServ shall be subject to the exclusive jurisdiction of the courts of India. By using this platform, you consent to this jurisdiction.

12. Termination

AmbrionServ may suspend or terminate your access to the platform at any time, with or without cause, and with or without notice. You may also delete your account at any time through the app settings. Upon termination, your right to use the platform immediately ceases.
